1. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) and other national data protection laws is:

Bogdan Sokolowski
Mommsenstr. 19
10629 Berlin
Deutschland

Telefon: +49 157 5311 5370
E-Mail: anfragen@soldinersee.de

If you have any questions about data protection or about exercising your rights, you can contact us at any time using the contact details above.

2. General information on data processing

The protection of your personal data is important to us. We process your data exclusively on the basis of the statutory provisions (GDPR, BDSG, TDDDG). This policy informs you about the nature, scope and purpose of the processing of personal data when you visit this website.

Personal data is any information relating to an identified or identifiable natural person (e.g. name, e-mail address, IP address). We only collect the data required to operate the website and to handle your enquiries. Processing always takes place on one of the following legal bases: consent (Art. 6(1)(a) GDPR), performance of a contract or pre-contractual measures (Art. 6(1)(b) GDPR), legal obligation (Art. 6(1)(c) GDPR) or legitimate interest (Art. 6(1)(f) GDPR).

3. Your rights as a data subject

With regard to the personal data concerning you, you have the following rights:

  • Access (Art. 15 GDPR) – whether and which data we process about you;
  • Rectification (Art. 16 GDPR) – correction of inaccurate data;
  • Erasure (Art. 17 GDPR) – the “right to be forgotten”, unless retention obligations apply;
  • Restriction of processing (Art. 18 GDPR);
  • Data portability (Art. 20 GDPR) – release in a structured, commonly used format;
  • Objection (Art. 21 GDPR) – to processing based on legitimate interest;
  • Withdrawal of consent (Art. 7(3) GDPR) – with effect for the future.

Irrespective of this, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for the controller is the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59–61, 10555 Berlin (www.datenschutz-berlin.de).

Right to object in individual cases

Insofar as we process data on the basis of legitimate interests, you have the right to object to this processing at any time on grounds relating to your particular situation. We will then no longer process the data concerned unless we can demonstrate compelling legitimate grounds that override your interests.

4. Hosting & server log files

This website is hosted as a static website with the following provider:

Vercel Inc.
340 S Lemon Ave #4133, Walnut, CA 91789, USA

When the website is accessed, the hosting provider automatically collects information transmitted by your browser and stores it in so-called server log files. In particular, the following are recorded:

  • IP address of the requesting device,
  • date and time of access,
  • page/file accessed and amount of data transferred,
  • referrer URL (previously visited page),
  • browser type and operating system used.

This data serves the technical provision, stability and security of the website (e.g. defence against attacks). The legal basis is our legitimate interest in secure and trouble-free operation (Art. 6(1)(f) GDPR). A data processing agreement (Art. 28 GDPR) is in place with the provider. Regarding the transfer to the USA, see section 9.

5. Fonts

This website uses exclusively fonts hosted locally on the server. No fonts are loaded from external providers (e.g. Google Fonts). When the fonts are loaded, no connection to third-party servers is established and no IP address is transmitted to third parties.

6. Map display (static map, OpenStreetMap)

In the “Location” section we show a static map graphic stored locally on our server. When the map is displayed, no connection to third-party servers is established and no IP address is transmitted to third parties. The graphic was created once in advance from map material by OpenStreetMap (© OpenStreetMap contributors, openstreetmap.org/copyright).

Below the map there is a text link “Open in OpenStreetMap”. Only when you click this link are you redirected to openstreetmap.org; the privacy policy of the OpenStreetMap Foundation then applies. The legal basis for the display is our legitimate interest in a user-friendly presentation of the location (Art. 6(1)(f) GDPR).

7. Contacting us

a) Contact form

If you contact us via the form, we process the data you provide: name, e-mail address, telephone number (optional), the plot of interest, your message as well as the optional indication of which documents you would like. We use this data exclusively to process your enquiry and for any follow-up questions.

The legal basis is Art. 6(1)(b) GDPR, since your enquiry is regularly aimed at concluding or initiating a land purchase (pre-contractual measure); otherwise our legitimate interest in responding to enquiries (Art. 6(1)(f) GDPR).

The form is transmitted in encrypted form (TLS). The technical sending of the enquiry to us as an e-mail is handled via the service provider Resend (Resend, Inc., 548 Market St Suite 64937, San Francisco, CA 94104, USA). A data processing agreement (Art. 28 GDPR) is in place with Resend. To protect against spam, we use a hidden form field (“honeypot”); no further automated evaluation of your input takes place.

b) E-mail

When you contact us by e-mail, we process your details (in particular e-mail address, name, content of the message) to handle your request. Incoming enquiries are stored in our e-mail inbox. The inbox is run via a private e-mail service; the provider is to be regarded as a recipient within the meaning of Art. 4(9) GDPR, not as a processor.

c) Telephone

When you contact us by telephone, we process the data provided during the conversation insofar as this is necessary to handle your request. Telephone calls are not recorded.

d) WhatsApp

On the website you will find buttons through which you can contact us via WhatsApp. Only when you click one of these buttons are you redirected to WhatsApp and data is transmitted to the operator Meta Platforms Ireland Ltd. or WhatsApp LLC (USA). We have no influence on the data processing by WhatsApp; the privacy policy of WhatsApp applies (whatsapp.com/legal). The legal basis for providing this contact channel and the transfer associated with its use is your consent granted by clicking (Art. 6(1)(a) GDPR) as well as our legitimate interest in an uncomplicated means of contact (Art. 6(1)(f) GDPR). Please note that WhatsApp may also transfer data to the USA. If you wish to avoid this, please use one of the other contact channels.

8. Recipients & processors

Your data is only passed on to third parties insofar as this is necessary to provide the services described or you have consented. In particular, the following may act as processors or recipients:

  • Vercel Inc. (USA) – hosting of the website; a data processing agreement is in place;
  • Resend, Inc. (USA) – technical sending of the form e-mails; a data processing agreement is in place;
  • Meta Platforms Ireland Ltd. / WhatsApp LLC (USA) – only when WhatsApp is actively used.

Transfer to public authorities only takes place within the framework of mandatory legal provisions. Your data is not sold.

9. Data transfer to third countries (USA)

Several of the services used are based in the USA or process data there. Insofar as data is transferred to the USA or another third country, this takes place on the basis of appropriate safeguards within the meaning of Art. 44 et seq. GDPR – in particular through certification of the recipients under the EU-US Data Privacy Framework and/or the conclusion of the EU Standard Contractual Clauses. With US providers, despite these safeguards, there remains a residual risk that US authorities may access the data for surveillance purposes without effective legal remedies by European standards being available against this.

10. Storage period

We store personal data only for as long as is necessary for the respective purposes:

  • Server log files are automatically deleted by the hosting provider Vercel after no more than 1 hour on the plan used;
  • Enquiries (form, e-mail) are stored until your request has been finally processed. If a contract is concluded, the statutory retention periods apply (in particular under commercial and tax law, up to 6 or 10 years);
  • Data based on consent is deleted after the consent is withdrawn, provided there is no other legal basis.

11. Cookies, tracking & analytics

This website uses no cookies for analysis or marketing purposes and uses no classic tracking services such as Google Analytics, no advertising networks and no social media plugins that transmit data in the background. No profiling and no cross-device or cross-site tracking takes place. A cookie banner is therefore not required.

To measure reach statistically (the number of page views and visits) we use Vercel Web Analytics, a service provided by our hosting provider Vercel Inc. (USA). Collection is cookieless and does not recognise you across different websites or sessions. No information is stored on or read from your device, so no consent under Section 25 TDDDG is required. From technical connection data (including IP address, browser and device information) Vercel derives an anonymised count value; the IP address is not stored permanently and is not passed on to us. We receive only aggregated statistics that cannot be traced back to individual persons. The legal basis is our legitimate interest in privacy-friendly reach measurement (Art. 6(1)(f) GDPR). For the transfer to the USA, see section 9. Further information: vercel.com/legal/privacy-policy.

12. SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, this website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in the address bar of your browser.

13. Changes to this policy

We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to implement changes to our services. The respective current version then applies to your next visit.

This privacy policy was created individually for this website. It does not replace legal advice in individual cases.
